Engaging our services

Consulting engagements are subject to a separate written agreement between common labs and the client. These Terms govern use of the Site only. Nothing on this Site constitutes a binding offer of services. All engagements commence only upon execution of a signed statement of work or services agreement.

2. Scope of services

Nature of advisory work

common labs provides AI strategy, implementation, and training services to organisations in the health and care sector. Our work is advisory and technical in nature. We do not provide legal, medical, financial, or regulatory compliance advice.

Where our work intersects with regulated domains — including clinical practice, aged care standards, privacy obligations, or data governance — clients are responsible for seeking appropriate professional advice from qualified practitioners in those fields.

No guarantee of outcomes

We work to the highest professional standard and stand behind the quality of our work. However, AI systems and digital transformation initiatives involve inherent uncertainty, and we do not guarantee specific business outcomes, cost savings, efficiency gains, or return on investment from any engagement.

Third-party tools and platforms

Our work may involve third-party AI platforms, software-as-a-service tools, or cloud infrastructure. common labs is not responsible for the availability, terms, or performance of third-party services. Clients are responsible for their own agreements with third-party providers.

3. Intellectual property

Site content

All content on this Site — including text, graphics, logos, and design — is the property of common labs Pty Ltd or its content suppliers and is protected by Australian and international copyright law. You may not reproduce, distribute, or create derivative works from any Site content without our express written permission.

Engagement deliverables

Intellectual property ownership for deliverables produced during client engagements is governed by the applicable services agreement. Unless otherwise agreed in writing, common labs retains ownership of all methodologies, frameworks, and pre-existing IP used in or resulting from engagements. Clients receive a licence to use deliverables for their internal business purposes.

4. Limitation of liability

To the maximum extent permitted by law, common labs Pty Ltd and its directors, employees, and contractors exclude all liability for any loss or damage arising from your use of the Site or reliance on its content, including but not limited to indirect, consequential, special, or incidental loss.

Where liability cannot be excluded by law — including under the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) — our liability is limited, to the extent permitted, to the cost of resupplying the relevant service or the cost of having the relevant service supplied again.

This limitation does not apply to liability arising from fraud, wilful misconduct, or death or personal injury caused by our negligence.
